Lawsuits

Be it known to all men that "The Holy Eastern Orthodox Catholic and Apostolic Church in North America" is, and has been since Feb. 1997, headed by Archbishop Victor. In 1998 an act of the Synod gave the Archbishop broader authority in the leadership of the Church. To this date the Archbishop has not abused his authority in any manner.

The Archbishop has acted to be certain the Church has good orthodox clergy. Those who are not Orthodox or refuse to obey the canons have left or been removed from office as the canons direct.

This Church and Archbishop Victor have suffered numerous attacks by both SCOBA (Schismatic) clergy and independent individuals who would claim to be part of the Archbishops Church under many names and many claim their lines of Apostolic Succession trace to this Church.

As Presiding Archbishop of the Church, Archbishop Victor has proclaimed that no member of the independent movement has any valid acceptable lines of succession from this Church. The only true lines come from this Church through members of this Church.

Defamation and Invasion of Privacy Lawsuit.

In 2004 after many years of harassment, invasion of privacy and lies Archbishop Victor and "The Holy Eastern Orthodox Catholic and Apostolic Church in North America" along with a co-Plaintiff, sued Montgomery Griffith-Mair in Garland County Circuit Court in Hot Springs, AR. for Defamation and Invasion of Privacy. The Lawsuit was filed on May 23, 2003 and trial was in April 2004. After a 1 day trial the Plaintiffs won a judgment from the Defendant who fled to England with warrants outstanding for numerous crimes including arson.

Copyright Infringement with Service Mark Infringment and Corporate Identity Theft

On June 28, 2010 Abp. Victor filed a lawsuit in U.S. District Court against Carl D. Bartholomew of Florida. He is said to be a Chiropractor and former Roman Catholic priest who claims to head the Holy Orthodox Church - American Jurisdiction. It appears he was unhappy with being a member of the independent Movement and decided in late 2007 to Incorporate in Florida as "The Holy Eastern Orthodox Catholic and Apostolic Church in N. America" (dropping the word North for the letter "N."). He then took our Registered Service Mark and placed it on his website claiming to be THEOCACNA. He took our church history, claims Archbishop Aftimios Ofiesh was the head of his group, first claimed to have been Chartered in 1937 and later claimed 1932. Much of this material appears to have came from our copyrighted website. He has also been claiming to be the "Society of Clerks Secular of Saint Basil" which was established within THEOCACNA in 1931, and was also a Registered Service Mark of THEOCACNA.

It appears that after we filed the lawsuit Carl Bartholomew moved from the Madison, FL area where he had claimed to reside for years to Gainesville, Fl. where the U.S. Marshals located and served him the Court papers.

Archbishop Victor plans more legal action against others who are involved in corporate identity theft that involves any claims that they are THEOCACNA under any name, as well as any matters of infringing our Copyrights and Service Marks.
